The implementation of land system is not appropriate due to the marine environment which is definitely different compare to land area where the boundary mark can�t be marked and seen directly. At present the practice of marine alienation occurs in a situation but nevertheless this is carried out based on the current rules and regulations. Tioman Island has been selected as a study area which having good marine environment for marine park area. This study is carried out in order to find out the significant of marine alienation for Marine Park and what are the existing acts or enactments that have been used in marine parks administration and management. The objectives of this study are to study the mechanism of marine alienation for marine park area and to evaluate the effectiveness of marine alienation for marine parks. The data acquisitions are based on primary and secondary data source. The information has been interpreted to achieve the objective of this study. Based on the result, the marine alienation is beneficial for Department of Marine Park Malaysia (JTLM) in administration and management of marine parks areas. The existing legislation in practice are relevant to use and shall be revised based on marine environment in order to govern marine parcel�s right, responsibility and restriction enforcement zulaihi UTM 109 p.
